Amended Petition
 Petitioner, Luther Lee Cannon a/k/a John Cannon, alleges that:
 1. Petitioner is the duly appointed and acting Personal Representative of the Estate of Marie Suzanne Cannon Hamil-ton, Deceased, having been appointed on March 15, 2022.
 2. Petitioner further alleges that the decedent died intestate on July 7, 2021, a resident of the State of South Carolina, County of Spartan-burg, leaving as her only heirs at law her brother, the Petitioner herein; her sister, Marquita Hamilton; her niece, Elizabeth Marie Sandrock; her nephew, Matthew David Kuhn; and her nephew Wesley Carter. Luther Lee Cannon, Jr. a/k/a John Cannon, Marquita Hamilton, Elizabeth Marie Sandrock and Matthew David Kuhn have all entered into an agreement pursuant to the provisions of Section 62-3-912 of the Code of Laws of South Carolina 1976, as amended, to the effect that Luther Lee Cannon, Jr., a/k/a John Cannon receive full title and ownership of all real and personal property of the estate of Marie Suzanne Cannon Hamilton, Deceased, and that he shall be in all respects the only heir and beneficiary of said estate, subject to the determination of this Court as to the interest, if any, of Wesley Carter, whose whereabouts are unknown. The Agreement is on file in the Spartanburg County Probate Court.
 3. After a thorough search, Petitioner has been unable to ascertain the whereabouts of the Respondent, Wesley Curtis Carter, and is unable to ascertain whether he is living or dead.
 4. Petitioner is informed and believes that pursuant to the provisions of Section 62-3-914 of the Code of Laws of South Carolina 1976, as amended, this Court should issue a notice addressed to all persons interested in the estate as heirs or devisees calling on the said Wesley Curtis Carter, his personal representatives, or heirs or devisees, to appear before the Court on a day and hour specified in the notice and to show cause why the personal representative should not be ordered to distribute the estate as if the said Wesley Curtis Carter had died prior to the death of Marie Suzanne Cannon Hamilton.
 5. Petitioner is further in-formed and believes that he is entitled to an Order of this Court declaring that the said Wesley Curtis Carter be presumed to have died prior to the death of Marie Suzanne Cannon Hamilton, and that the Person-al Representative be ordered to distribute all assets of the estate as if Wesley Curtis Carter has predeceased prior to the death of Marie Suzanne Cannon Hamilton pursuant to the provisions of Section 62-3-914 of the Code of Laws of South Carolina 1976, as amended.
  WHEREFORE, Petitioner prays that this Court issue a Notice to Show Cause pursuant to the provisions of Section 62-3-914 of the Code of Laws of South Carolina 1976, as amended, calling on Wesley Curtis Carter, or his Personal Rep-resentative or his heirs or devisees, to appear before the Court to show cause why the Personal Representative should not be ordered to distribute all assets of the estate as if the said Wesley Curtis Carter had died prior to the death of Marie Suzanne Cannon Hamilton.
