GENERAL ALLEGATIONS
 1. Plaintiff, Alshard Jaquinn Harris (hereinafter “Plain-tiff”) is a citizen and resident of Cherokee County, South Carolina.
 2. Upon information and belief, Defendant Marcia A. Batson (hereinafter “Defendant Batson”), is a citizen and resident of Spartanburg County, South Carolina.

As Plaintiff so traveled, the vehicle directly in front of him swerved around Defen-dant Gory’s 1987 Chevrolet SUV that upon information and belief, had broken down in the roadway. Defendant’s Chevrolet SUV, although disabled at night in the middle of a busy multilane road, did not have taillights, brake lights, or hazard lights activated and therefore, could not be seen by approaching motorists in a timely manner. Plaintiff therefore collided with Defendant’s stalled vehicle.
 7. Defendant Gory’s SUV, upon information and belief, was being driven by Defendant Batson when it broke down.
 8. As a direct and proximate result of the collision, Plaintiff suffered injuries and damages as set forth hereinbelow.
PLAINTIFF’S FIRST CAUSE OF ACTION AS TO DEFENDANT BATSON
(NEGLIGENCE)
 9. Plaintiff incorporates herein by reference each and every allegation set forth hereinabove as if repeated verbatim.
 10. Defendant Batson was negligent, grossly negligent, reckless, willful, and wanton in the following particulars, to wit:
 (a) In failing to remove the vehicle from the roadway;
 (b) In failing to turn on proper warning lights or signaling devices so as to warn motorists of the presence of the stalled vehicle.
 (c) In generally failing to exercise the degree of care and caution that a reasonably prudent person would have exercised under the conditions then and there existing.
 11. As a direct and proximate result of the aforementioned acts of negligence, gross negligence and recklessness on behalf of Defendant Batson, Plaintiff suffered physical injuries that required expensive and extensive medical care and treatment and resulted in medical expenses, loss of enjoyment of life, and physical pain and suffering.
FOR A FIRST CAUSE OF ACTION AS TO DEFENDANT GORY (NEGLIGENCE)
 12. Plaintiff incorporates herein by reference each and every allegation set forth hereinabove as if repeated verbatim.
 13. Defendant Gory was negligent, grossly negligent, and reckless in the following particulars, to wit:
 (a) In failing to properly maintain her vehicle;
 (b) In failing to ensure that all tail lights and hazard lights were in proper working order;
 (c) In failing to act as a reasonable and prudent person would have acted under the conditions then and there existing.
 14. As a direct and proximate result of the aforementioned acts of negligence on behalf of Defendant Gory, Plaintiff suffered physical injuries that required expensive and  extensive medical care and treatment and resulted in medical expenses, loss of enjoyment of life, and physical pain and suffering.
 WHEREFORE, Plaintiff prays for judgment against Defen-dants for actual and punitive damages, for the costs of this action, and for such other and further relief as the Court deems just and proper.
